  • Does the state provide a free lawyer if the defendant cannot afford the lawyer's expenses?

    The state bears the expenses of the lawyer for the accused in major crimes only, provided that he is unable to pay the lawyer's fees.

  • What is the procedure followed when the defendant's residence data is not available to the plaintiff?

    The applicant may select the pledge box not to know the defendant’s location, which is located below the defendant’s data field.

  • Are there any legal costs for cases that end in dismissal due to the non-attendance of the plaintiff or others?

    Yes, when the judgment is issued regardless, the plaintiff bears the legal costs.

  • Are legal costs refunded if the plaintiff drops the case?

    If the plaintiff abandons his lawsuit before the first session is held, he shall be entitled to recover the legal costs in accordance with the regular procedures.

  • How long is the period specified for stopping the proceedings of the lawsuit?

    The lawsuit may be suspended based on the agreement of the parties not to proceed with it for a period not exceeding six months from the date on which the court approves their agreement. If the court sees that its ruling on the subject of the lawsuit is suspended on the settlement of another issue on which the ruling depends, it shall order the suspension of the lawsuit. Once the reason for the suspension has been removed, the parties may request the continuation of the lawsuit.

  • What is the statutory period for objecting to a court ruling?

    The period for objecting to an appeal request is (30) days, except for urgent lawsuits, in which the period for objection is (10) days.

  • Who is the notary?

    Pursuant to the decision of the Minister of Justice No. 66954 dated 07/10/1435 AH regarding the regulations of notaries and their work, and the first article of the regulations stipulates that the notary shall be granted a notarization license after the conditions of the notary’s service apply to him and he passes the personal interview. The most prominent of these conditions are that he be Saudi and hold a university degree or have previously worked in the judiciary, notary public, or law, etc.

  • An elderly person with Alzheimer's disease and we want to make a power of attorney from him. Is that possible?

    If he is not mentally aware, a guardianship certificate shall be issued for him from the Personal Status Court, and according to it, the guardian shall act on his behalf in what he is entrusted with.

  • If a woman has a national ID, does she need an ID to make a legal power of attorney?

    If her fingerprint is registered in the civil status system, then there is no need for identification.

  • How many IDs does a woman need if she does not have a fingerprint in the civil status system?

    One identifier if he is a mahram to her, or two identifiers if he is not a mahram.

  • My brother is mute and cannot speak. How can I get a power of attorney for him?

    A set of documents showing the description of the property, its location, its physical and legal condition, the rights and obligations attached to it, and the amendments that occur thereto, in light of the documents considered legal. The real estate registry includes the title deed and the real estate newspaper.

  • What documents does the real estate registry issue?

    The Real Estate Registry issues two documents to prove real estate ownership after completing the first physical registration, which include: Ownership Registration Deed: An ownership document issued by the Real Estate Registry to prove the property data, including its type, condition, owner data, rights, restrictions, obligations, and any other data according to the form specified by the regulation. Real Estate Newspaper: A document containing the data mentioned in the property registration deed in addition to a description of the property and the changes and amendments that occur to it in chronological order in light of the documents considered by the system, such as a change in owners, or the property boundaries or uses.

  • What is the difference between documenting real estate in the real estate registry and documenting it with the Ministry of Justice?

    The real estate registry relies on the property as a basis for documenting real estate ownership, distinguishing the property with an identification number (property number), in addition to determining its exact location using the latest geospatial surveying technologies, which gives real estate ownership the highest degree of reliability.

  • What is meant by real estate right?

    A direct authority granted by law to one or more persons - whether natural or legal - over a specific property, authorizing them to dispose of it or benefit from it.

  • Who is the real estate registrar?

    A licensed individual who documents the first real estate registration, and any actions or changes in the description of the property, in accordance with the provisions of the system and regulations.

  • What does it mean to grant absolute authority?

    Title deeds issued by the Real Estate Registry grant absolute authority to real estate ownership after one year from the date of issuing the lists of owners. Absolute authority is considered the highest degree of proof according to the real estate registration system, and its content is implemented before the judiciary and all parties without additional evidence, and it may not be appealed, overturned or cancelled, unless the appeal is due to a clerical error or forgery.

  • When does a title deed become absolute?

    The title deed becomes absolutely valid after one full year has passed since the lists of owners of the properties that have been registered in kind have been published on the real estate registry platform without any objection being submitted to it according to the regulations.

  • What are the requirements for the first registration of the property?

    Valid national ID or residency for individuals

    There is no fee for the first eye registration, and it is provided free of charge to beneficiaries in the announced real estate areas.

  • Can I register a property with a non-electronic deed?

    An electronic deed is required for the first physical registration of the property in the real estate registry.

  • Is registration mandatory and what are the consequences of not registering?

    Yes, registration is mandatory during the period specified for receiving applications for the first real estate registration. Failure to submit the application during that period will result in obligations according to Article Thirty-Five of the Real Estate Real Estate Registration System.

  • What are the procedures for sorting or merging a property?

    The individual owner can submit a request for sorting or merging through the real estate registry platform. To implement the service, a decision or approved report for sorting or merging from the competent authority must be attached.

  • How is the endowment registered on the property?

    The request to add the right to endowment is submitted by attaching the endowment deed from the Ministry of Justice or the endowment certificate from the General Authority for Endowments.

  • What are the terms and conditions for the property transfer service on the real estate registry platform?

    The property must have been registered in kind with the real estate registry, and there must be no rights or obligations on the property.
